Judicial activism

I’ve been keeping my eyes on the coverage of Sotomayor’s judicial hearings this morning, but most of what I’ve heard so far was strictly partisan praise or criticism from various senators. Makes me wonder if the one fellow wasn’t right when he defined “judicial activism” as “court decisions that I don’t agree with.” One senator trotted out a whole list of conservative “activism” while another had a list of liberal “activism.” Perhaps none of it has actually been “activism”–just business as usual for the Supreme Court. Anyway, it’s an interesting concept to think about, and I’m sure we’ll hear a good bit about this over the next couple of days.
